Terms and conditions

Please read these terms and conditions carefully before using this website.

Before placing an order with the DSMS E-SHOP you must have read and agreed to these Terms and Conditions. If you are unhappy with any aspect of these, then you should contact our customer service via email at customerservice@dsm-sg.com before placing your order with us.

Buying products on our website

To order a product, you will need to register, login and follow the procedures set out in the Exploring the DSMS E-SHOP section of our FAQs.

After placing an order with DSMS E-Shop, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. DSMS E-Shop must receive payment of the whole of the price for the goods that you order before your order can be accepted. Once payment has been received by us and availability of the product you have ordered is verified, we will send you an email confirming that your order has been accepted and has been dispatched. Our acceptance of your order brings into existence a legally binding contract between us.

Availability

All items are subject to availability. DSMS E-Shop will inform you as soon as possible, before accepting your order, if the goods you have ordered are not available.

Prices and Payment

All prices on the DSMS E-SHOP are given in Singapore Dollar ($) but exclusive of delivery costs and import taxes outside Singapore. Please see the FAQs for current delivery costs and delivery dates by clicking here.

You must pay by debit or credit card at the time of the order. The price of any product is the price at the date and time of your order. We may change the price of any product before you place an order. Before accepting your order, we will inform you if a product's correct price is higher than that stated in your order and you may cancel the order.

Cancellation and Returns

Cancellation by DSMS E-SHOP

Sales from specified product launches will be final as stated with 1 order per delivery address. Multiple orders from customers may result in cancellation and a full refund will made. All final sales are strictly not returnable, unless goods are damaged or wrongly delivered.

Cancellation by you

Under the Singapore regulations you have the legal right to refund your DSMS E-Shop's order within 14 days of receipt of the goods. If you want to cancel your order, you need to notify us in writing within those ten days and request a Goods Return Number (GRN) from DSMS E-Shop. Once you have notified us, any sum debited from your credit or debit card (less shipping fee) will be re-credited to your account as soon as possible and in any event within 30 days of your order with DSMS E-Shop.

Conditions in relation to returns

All DSMS E-Shop's items intended for return must have a Goods Return Number (GRN). GRNs must be obtained within 14 days of receipt of delivery by clicking here and completing the GRN form. DSMS E-Shop will then reply with a GRN number. Once you have received this, please ensure that you follow the instructions emailed to you.

Notification of returns received outside of the above time frames will not be accepted by DSMS E-Shop.

DSMS E-Shop will only accept returns provided that the goods in question are returned by you and received by us in the condition they were in when delivered to you.

You have a legal obligation to take reasonable care of the items while they are in your possession. If you fail to comply with this obligation, your entitlement to a refund may be affected. We request that you do not remove tags and hygiene seals until you are completely satisfied that the items will not be subject to return within 14 days. We also request that items are returned with their original packaging including, in the case of shoes, original boxes.

This is not intended to be a full statement of your rights under the Singapore regulations. Full details of your rights under the Singapore regulations are available from you local Citizen’s Advice Bureau or your Local Authority’s Trading Standard’s Office.

Exchange

DSMS E-SHOP does not conduct exchanges. Item(s) must be returned and a new purchase be committed.

Faulty Goods

All items returned as faulty will be inspected and any items deemed to subject to fair wear and tear will not be accepted as faulty.

Goods are classified as faulty if they are received damaged, or where a manufacturing fault occurs within six months of purchase. Please note that items that are damaged as a result of wear and tear are not considered to be faulty.

In case we cannot offer you a replacement, you will receive refund to the value of the item at the time of purchase and any shipping costs occurred. Please note that refunds onto credit cards can take up to 30 days and are subject to your bank’s refund regulations.

Liability

Our liability for losses you suffer as a result of us breaking this agreement is strictly limited to the purchase price of the Product you purchased and any losses which are a foreseeable consequence of us breaking the agreement. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us.

You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.

Nothing in these terms and conditions limits any statutory rights you might have as a consumer or our liability to you for any fraud, fraudulent misrepresentation, death or personal injury resulting from our negligence.

Information you provide

You confirm that all information supplied by you in using this website is true and accurate and that you have the legal authority to purchase goods or services using this website.

By accepting these terms and conditions, you authorise us to use, store or otherwise process any personal information which related to and identifies you to the extent reasonably necessary to provide the services which are available through our website.

Security

We use a SECURE SOCKET LAYER (SSL) protocol to protect your information against any leakage or misuse. The use of SSL encryption scrambles data sent from the browser to the DSMS E-SHOP server in such a way that only we can read it. If SSL is enabled then you will see a padlock at the bottom of your browser and you can click on this to find out information about the SSL digital certificate registration. The Secure Sockets Layer (SSL), created by Netscape, is the standard for secure data transmission over the Internet. SSL uses authentication and encryption technology developed by RSA Data Security Inc. Web browsers such as Netscape's Navigator and Microsoft's Internet Explorer support SSL.

We take all reasonable care to make our website as secure as possible. We will take all reasonable care to keep the details of your order and payment secure and in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Site. Furthermore, you are solely responsible for maintaining the confidentiality of your password and account username.

Ownership of rights

All rights, including copyright, in this website are owned by or licensed to Dover Street Market Singapore. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of Dover Street Market Singapore. You may not modify, distribute or re-post anything on this website for any purpose.

Accuracy of content

We take every care to ensure that the description and specification of our products are correct at the time of publication. However, while the colour reproduction of the products is a close representation, we cannot accept any responsibility for any variation in colour caused by the browser software or computer system used by you. Orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. To the extent permitted by applicable law, we disclaims all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website. We shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials on this website.

Entire Agreement

We intend to rely upon these terms and conditions and any document expressly referred to in them in relation to the subject matter of the contract between us. While we accept responsibility for statements and representations made by our duly authorised agents and we will provide you with any variations from these terms and conditions to be confirmed in writing.

Acceptable use

You must not use this website in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity. You must not use this website to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software. You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to this website without express written consent.

Jurisdiction

Your use of this Website shall be governed by, and interpreted in accordance with the laws of Singapore. The courts of Singapore have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms and Conditions and your use of this Website (including a dispute regarding the existence, validity or termination of these Terms and Conditions (a “Dispute”). You agree that the courts of Singapore are the most appropriate and convenient courts to settle a Dispute and you agree not to make any argument to the contrary. However this shall not affect any mandatory statutory rights that the Customer may have under laws of their local jurisdiction.
