Please read these terms and conditions carefully before using this website.

Your use of our website and purchase of any of our products is subject to these terms and conditions and by using our website and/or purchasing a product, you agree to be bound by these terms. If you are unhappy with any aspect of these, then you should contact our customer service via email at e-shop@doverstreetmarket.com before placing your order with us.

We may amend these terms from time to time, but any changes to these terms will not affect any order already made by you. Every time you wish to use our website, please check these terms to ensure you understand the terms that apply at that time. These terms were most recently updated on 23 May 2018.

Buying products on our website

To order a product, you must first create an account with us. You will need to provide us with your name and email address to register with us. You will also be required to create a username and password. After creation of the account, you will be sent a confirmation e-mail with your account details.

You may place an order for the products on the website by following the various prompts on screen to add a product to your basket. When you have placed all the products you wish to purchase into your basket you may proceed to the check-out area of the website and submit your order to us by clicking the “Proceed to checkout” button.

After placing an order with us, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted.

We require payment of the whole of the price for the goods that you order before your order can be accepted. Once payment has been received by us and availability of the product you have ordered is verified, we will send you an email confirming that your order has been accepted and has been dispatched. Our acceptance of your order brings into existence a legally binding contract between us in relation to the purchase of those products.

Availability

All items are subject to availability. We will inform you as soon as possible, before accepting your order, if the goods you have ordered are not available.

Prices and Payment

All prices on the DSML E-SHOP are given in British Pounds Sterling (£) and are shown inclusive of UK sales tax (VAT) at the current rate of 20% but exclusive of delivery costs. Please see the FAQs for current delivery costs and delivery dates by clicking here.

If your order is being dispatched to a destination outside the European Union (EU) then VAT will be deducted at the checkout stage and this will be shown on your invoice. If your order is being dispatched to a country which is a member state of the EU then the total price will include VAT at the current rate.

Please note DSML E-SHOP has no control over any customs or import duties that could be levied when the package reaches your destination country and for which you will be liable.

You must pay by debit or credit card (we accept Visa, MasterCard, Delta, Switch and American Express) or by using PayPal, at the time of the order. We take all reasonable care to ensure that the price of the product listed on our site is correct. We will normally check prices before accepting your order so that, where the product's correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the product's correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order. If we accept and process your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the contract, refund you any sums you have paid and require the return of any goods provided to you.

You should be aware that online payment transactions are subject to validation checks by your card issuer and we are not responsible if your card issuer declines to authorise payment for any reason. Please note, it is possible that your card issuer may charge you an online handling fee or processing fee - we are not responsible for this.

Delivery

The products will be delivered to the delivery address specified by you on the order form. You must therefore ensure its accuracy. Please ensure the address you provide is one where our delivery service can obtain a signature upon delivery of your shipment.

Due to shipping restrictions, we are not able to ship to Post Office boxes.

Please note that we can only ship perfume to the following countries: Austria, Belgium, Bulgaria, Czech Republic, Denmark, Estonia, Finland, France, Germany, Hungary, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Slovakia, Slovenia, Spain, Sweden, Switzerland, and United Kingdom.

Products comprised within the same order cannot be delivered to different addresses.

Cancellation and Returns

Cancellation by you

PLEASE NOTE THE FOLLOWING SECTION SHALL ONLY APPLY IF YOU ARE RESIDENT IN THE EUROPEAN UNION.

For most products bought online you have a legal right to change your mind within 14 days of receiving the products and receive a refund.

Please note, this right will not apply to personalised items or goods which have been made to a customer's specification. In addition, for hygiene reasons, your right to cancel will not apply to:

  • Beauty products or fragrances where the packaging has been removed or tampered with;
  • Ladies' and men's briefs, swimming costumes and bikini bottoms, unless the protective adhesive strip is still in place; and
  • Jewellery items for piercings e.g. earrings, nose rings.

To exercise your right to cancel, you must inform us of your decision to cancel the contract by doing one of the following:

  • Email: please email us at e-shop@doverstreetmarket.com; and
  • Post: print off the model cancellation form set out at the end of these terms and send it to: DSML E-SHOP, Hermitage Lane, Aylesford, Kent, ME20 7PX, United Kingdom.

When notifying us, you should provide your name, home address details of your order, and where available, your phone number and email address. At the bottom of these terms is a model cancellation form, which you may use if you wish.

If you cancel the contract, we will reimburse all payments received from you, including the cost of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us). We may make a deduction from the reimbursement for loss in value of any products supplied, if the loss is the result of unnecessary handling by you. You should therefore take reasonable care of the products while in your possession. We request that you do not remove tags and hygiene seals until you are completely satisfied that the items will not be subject to return. We also request that items are returned with their original packaging including, in the case of shoes and jewellery, original boxes. If we refund you the price paid before we are able to inspect the goods and later discover you have handled them in an unacceptable way, you must pay us an appropriate amount.

We will make the reimbursement without undue delay, and not later than:

    • 14 days after the day we receive back from you any products supplied; or
    • (if earlier) 14 days after the day you provide evidence that you have returned the products.

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless we have both expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

You shall send back the goods to DSML E-SHOP, Hermitage Lane, Aylesford, Kent, ME20 7PX, United Kingdom, without undue delay and in any event not later than 14 days from the day on which you tell us you wish to end the contract.

Please note that items purchased online from the DSML E-SHOP cannot be returned to the DSM store.

You will have to bear the direct cost of returning the goods. When returning items, you are strongly recommended to obtain proof of posting. We cannot accept responsibility for parcels lost in transit and you are advised to arrange your own insurance. We will only refund or provide an exchange for the costs of postage / transport where the item returned is faulty.

Faulty Goods

If you receive a product and find it is damaged or faulty when it is delivered to you or develops a fault, you may have one or more legal remedies available to you, depending on how quickly you make us aware of the problem. Where you believe a product was delivered damaged or faulty or has developed a fault, please inform us as soon as possible, preferably in writing, giving your name, address and order number. Nothing in this section affects your legal rights.

Liability

We are only liable for any losses which are a foreseeable consequence of us breaking the terms of this agreement. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us.

You must observe and comply with all applicable laws, including obtaining all necessary customs, import or other permits to purchase goods from our website. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.

Nothing in these terms and conditions limits or excludes any statutory rights you might have as a consumer or our liability to you for fraud, fraudulent misrepresentation, death or personal injury caused by our negligence, or for any other liability that we cannot legally limit or exclude.

Availability and security

Our website is made available free of charge. We do not guarantee that our website, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our website for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.

You are also responsible for ensuring that all persons who access our website through your internet connection are aware of these terms and other applicable terms and conditions, and that they comply with them.

We use a Secure Sockets Layer (SSL) protocol to protect your information against any leakage or misuse. The use of SSL encryption scrambles data sent from the browser to the DSML E-SHOP server in such a way that only we can read it. If SSL is enabled then you will see a padlock at the bottom of your browser and you can click on this to find out information about the SSL digital certificate registration. The SSL, created by Netscape, is the standard for secure data transmission over the Internet. SSL uses authentication and encryption technology developed by RSA Data Security Inc. Web browsers such as Netscape's Navigator and Microsoft's Internet Explorer support SSL.

We take reasonable care to make our website as secure as possible. We will take reasonable care to keep the details of your order and payment secure. You are solely responsible for maintaining the confidentiality of your password and account username. If you know or suspect anyone other than you knows your username or password, you must promptly notify us at e-shop@doverstreetmarket.com.

We do not guarantee that our website will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform to access our website. You should use your own virus protection software.

Ownership of rights

All rights, including copyright, in this website are owned by or licensed to Dover Street Market International (DSMI) Ltd. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of Dover Street Market International (DSMI) Ltd. You may not modify, distribute or re-post anything on this website for any purpose.

Accuracy of content

We take every care to ensure that the description and specification of our products are correct at the time of publication. However, while the colour reproduction of the products is a close representation, we cannot accept any responsibility for any variation in colour caused by the browser software or computer system used by you. Orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. To the extent permitted by applicable law, we disclaim all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website.

Where our website contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. We have no control over the contents of those sites or resources.

Acceptable use

Please note that we only provide our website for domestic and private use. You agree not to use our website for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

You must not use this website in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity. You must not use this website to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software. Jurisdiction

This website, these terms and conditions and any contract entered into as a result of usage of this website are governed by and construed in accordance with English Law. The parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales, except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

Other important terms

We may transfer our rights and obligations under these terms to another organisation. You may not transfer or assign any or all of your rights or obligations under this contract to anyone else.

Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms.

Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

These terms constitute the entire agreement between you and us in relation to the subject matter of any contract. We are required by law to advise you that the contract between us and you created under these terms may be concluded in the English language only and that no public filing requirements apply.

If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
